Terms of Service

DRAFT β€” needs legal review before publishing. This document is a good-faith working draft written by the studio to describe how Mushroom Capital actually works. It has not been reviewed by a lawyer. Sections marked β€œFor counsel” are placeholders that a qualified attorney must complete or replace before these Terms are relied upon or published.
The short version. Be 13 or older. Play fair, be kind, and don't break or exploit the game. Everything you can send to another player comes from our built-in set β€” there is no free typing, no uploads. Virtual items are a licence to use inside Mushroom Capital only: they aren't real money, can't be cashed out or traded, and we can change or remove them. Break the rules and we can suspend or close your account. The game is provided "as is."

These Terms are a legal agreement between you and Such Software ("we", "us", "the studio") governing your use of the Mushroom Capital game and this website (together, the "Service"). By downloading, accessing, or playing, you agree to these Terms and to our Content & Community Policy and Privacy Policy, which are part of this agreement. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 13 years old to play. Mushroom Capital is rated 13+ and is not designed for, or directed to, children under 13. By using the Service you represent that you are 13 or older. If we learn that a user is under 13, we may close the account and delete the associated data. Where your local law sets a higher age of digital consent, you must meet that age (or have verifiable parental consent) to use the Service.

2. Your licence to play

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play Mushroom Capital for your own non-commercial entertainment. You may not copy, modify, reverse-engineer, decompile, resell, rent, or redistribute the game or its assets except where that restriction is prohibited by law. All game content, art, code, and trademarks remain the property of Such Software or its licensors.

3. Accounts

You can play anonymously with a device-generated ID, or optionally link a Google, Apple, or email identity for cross-device play. If you link an identity, you're responsible for keeping it secure and for activity under your account. We use a server-authoritative model β€” your saved progress on our servers is the source of truth. You may delete your account and data at any time from Settings in the app, or by contacting us (see Privacy Policy).

4. Acceptable use & conduct

Mushroom Capital includes a light, friendly social layer (visiting friends' rooms, leaving reactions, sending built-in messages and cosmetic gifts) plus optional private/open catalog-action minigames. Your use of it is governed by our Content & Community Policy, which is incorporated into these Terms. In short, you agree not to:

Violations may result in content removal, feature restrictions, suspension, or permanent termination (see Β§8).

5. All cross-player content is catalog-only

This is a core design rule of the Service, and it protects every player. The only things that travel from one player to another are items we built and pre-approved ourselves β€” a curated set of canned messages and notes, a fixed set of reaction stamps/emotes, gifted cosmetic props from our catalog, fixed minigame actions, and a length-limited filtered display name.

Because of this, the only free-form thing you control that others see is your display name, which is length-limited and reportable. You agree not to use your display name to convey anything that would violate the Content & Community Policy.

7. Rewarded ads

The game may offer optional, opt-in rewarded ads: you choose to watch a short ad in exchange for an in-game reward. Ads are never forced. See our Privacy Policy for how ads are served (non-personalized).

8. Suspension & termination

We may restrict features, suspend, or permanently terminate your access to the Service (in whole or in part) if you violate these Terms or the Content & Community Policy, if required by law or a platform, or to protect the Service or its players. Where reasonable and lawful, we aim to give notice and, for social-content actions, a brief statement of the reason (see Β§9). You may appeal an action as described in the Content & Community Policy. You may also stop using the Service and delete your account at any time. Terminating an account does not entitle you to a refund of unused virtual items, except where required by law.

9. Reporting, notice & action, and point of contact (EU DSA)

Every place where one player can see another player's content (a visited room, a friend, a message) includes Report and Block tools. When you submit a report, it reaches the studio for human review, and we may remove or hide the reported content, restrict features, or suspend the account involved.

Consistent with the EU Digital Services Act, we operate a notice-and-action process: you can notify us of content you believe is illegal or breaks our rules, we acknowledge and review notices, and where we remove or restrict player content we aim to provide a concise statement of reasons to the affected user and information on how to appeal. Because all cross-player content is drawn from our own pre-vetted catalog (Β§5), the volume of such content is deliberately small.

Point of contact. In-app Report reaches the studio for review. For legal notices, DSA notices, copyright/DMCA complaints, and child-safety concerns, contact the studio's legal team at legal@such.software (security@mushroom.capital for security issues; hello@mushroom.capital for general questions). Such Software maintains the applicable reporting registrations, including a DMCA designated agent and a registered channel for reporting apparent child sexual abuse material to NCMEC. We accept communications in English.

10. Availability & changes

We may update, suspend, or discontinue the Service (or parts of it) at any time. We may also update these Terms; if changes are material, we'll update the date above and, where appropriate, notify you in-game. Continued play after changes means you accept them.

11. Intellectual property & real-world imagery

Mushroom Capital, its logos, art, characters, and content are owned by Such Software or its licensors and are protected by intellectual-property laws. You receive only the limited licence in Β§2.

Copyright / DMCA. Players do not upload files, and all cross-player content is drawn from our own catalog (Β§5) β€” but we still respect intellectual-property rights. If you believe content in the Service infringes your copyright, send a notice with the information required by the DMCA to our designated agent at legal@such.software, and we will respond consistent with applicable law.

12. Disclaimers & limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law.
